Abdelkrim Belachheb, a 39-year-old Moroccan national and resident alien, opened fire in Ianni's Restaurant and Club, a bar, killing six and severely injuring one. As under Texas law multiple murder by itself was not one of the aggravating factors required to make murder a capital crime, Belachheb could not be sentenced to death.
